RE:
Request that the Board waive the $500 campaign finance late fee assessed against Kevin Guillory, a candidate for Judge, Criminal District Court, Section D and his committee's chairperson, Gregory Thompson, and treasurer, Shalita Sanders, for the November 8, 2016 election, whose 40-G campaign finance disclosure report was filed 5 days late.
Facts:
Kevin Guillory states Ms. Sanders is responsible for managing all campaign finance and completing all reports. The week of January 16th, he states he was contacted by Ms. Sanders about upcoming reporting deadlines. He states he knew she was working on the report because she was in contact with various committee members regarding expenditure or documentation needed for the report. However, on Wednesday, January 18, 2017, he stated that Ms. Sanders informed him that she had a family emergency and would be leaving to go out of town. He stated that he received the NOD and contacted Ms. Sanders. He states that she apologized and promised to file the report as soon as she returned. On January 23, 2017, he states that she returned and filed the report on the January 24, 2017.


Ms. Sanders submitted medical documentation related to a serious wreck her sister and grandmother were in on January 18, 2017, which caused her to have to travel out of town and file the report late.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee pursuant to Rule 1205B(2).
