Waiver request submitted by Alva See, III, a member of the Municipal Yacht Harbor Management Corporation, regarding a $1,500 late fee assessed for filing his 2015 Tier 2.1 pfd 98 days late.
Facts:
Mr. See states that he failed to file the report on receipt of the NOD because he was planning the funeral of his sister who passed away on September 21, 2016. The NOD was received on October 3, 2016 and the funeral was on October 15, 2016. He states the late fee will create a financial burden as he tries to pay down his sister's medical bills.

A request for supporting documentation has been issued. Mr. See submitted a letter stating his 54 year old sister went through a 30 month battle with a terminal illness. Mr. See states with the Board's limited time of review, HIPPA privacy limitations and the very private nature of the Board's request, Mr. See has chosen to limit his response. Mr. See attached a bill and list of hours for home care. The medical bill is for $4,924.19 showing a date of service as June 9, 2014 and statement date of July 8, 2014, two years prior to the pfd due date.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all but $450 based on future compliance with the reporting requirements under the Code of Ethics. The $450 is payable within 30 days and if payment is not received within 30 days, the full amount of the late fee becomes due and owing.
