Advisory opinion regarding whether Dr. Michael Williams may become an employee or an independent contractor of Acadia-St. Landry Hospital.
Facts:
Dr. Williams is a licensed physician currently serving as Chairman of the Board of Commissioners of the Acadia-St. Landry Hospital Service District (District). The District owns and operates Acadia-St. Landry Hospital, which is located in both Acadia Parish and St. Landry Parish. The 2010 federal census states that Acadia Parish has a population of 61,773 and St. Landry Parish has a population of 83,384 with the two parishes having a combined population of 145,157.
Law:
La. R.S. 42:1121(H) provides that a licensed physician who is a former member of the governing authority of a hospital service district or any legal entity in which he is an officer, director, trustee, partner, or employee is not prohibited from being employed by or contracting with the hospital service district or any entity over which the governing authority of any hospital service district exercises supervision or jurisdiction to perform professional health care service directly related to his expertise as a licensed physician. La. R.S. 42:1113B prohibits an appointed member of a board or commission from bidding on, entering into, or being in any way interested in a transaction that is under the supervision or jurisdiction of the agency of the appointed board member.

La. R.S.42:1123(18)(a) which allows a licensed physician who is a member of a board of commissioners for any hospital service district located within a parish which has a population of 125,000 or less from contracting with the hospital over which the board exercises jurisdiction.

Recommendations:
Adopt the proposed advisory opinion.
