Request that the Board waive the $240, $60, $600 and $120 campaign finance late fees assessed against Antoine Pierce, a candidate for Councilman / Metro District 8 in the November 8, 2016 election, whose 180-P, 30-P, 10-P and 10-G campaign finance disclosure reports were filed 88, 1, 12 and 2 days late respectively.
Facts:
Antoine Pierce states that the report preparer experienced a sudden and tragic loss in her family and forgot to submit the report. When made aware of the oversight, he states that he immediately submitted the 30-P report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee for the 180-P report.

Suspend all for the 30-P report.

Suspend all but $200 for the 10-P report based on future compliance. The late fees must be paid within 30 days or the suspended portion becomes due and owing.

Decline to waive for the 10-G report.
