Advisory opinion request by Tangipahoa Parish President Robby Miller regarding whether his wife's company, Bean Town LLC, can continue an agreement with Tangipahoa Parish Hospital Service District No. 1 d/b/a North Oaks Hospital while he serves as the Parish President.

Robby Miller was elected Tangipahoa Parish President and took office on January 11, 2016. The Tangipahoa Parish Council appoints the Board of Directors of Tangipahoa Parish Hospital Service District No. 1. Mr. Miller stated that the Parish President has no role in the appointment, oversight, or supervision of the Board of Directors or any employees of the District.

Mr. Miller's wife, Donna Miller, wholly owns Bean Town, LLC. A contract between Bean Town and North Oaks Hospital, which was originally entered into on August 12, 2011. A contract between the parties was entered into on or about December 8, 2016 extending the term until September 30, 2017 and increasing the rent annually by $834.72. The new agreement provides for a one year automatic renewal option if both parties consent. No terms of the contract would change if the automatic renewal was approved by both parties; however, North Oaks would have the right to adjust the rent upon at least sixty days written notice prior to any upcoming renewal.
Law:
La. R.S. 42:1113A(1)(a) provides that no public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1114A provides that other than a legislator, each public servant and each member of his immediate family who derives any thing of economic value, directly, through any transaction involving the agency of such public servant or who derives any thing of economic value of which he may be reasonably expected to know through a person which (1) is regulated by the agency of such public servant, or (2) has bid on or entered into or is in any way financially interested in any contract, subcontract, or any transaction under the supervision or jurisdiction of the agency of such public servant shall disclose the following:(1) The amount of income or value of any thing of economic value derived;(2) The nature of the business activity;(3) Name and address, and relationship to the public servant, if applicable; and(4) The name and business address of the legal entity, if applicable.
