Advisory opinion request regarding whether the post-employment restrictions would prohibit former Lafourche Parish Administrator, Archie Chaisson, from being appointed as a member of the Lafourche Parish Coastal Zone Management Advisory Committee.
Facts:
Lafourche Parish Assistant District Attorney Lisa Orgeron stated that Mr. Chaisson served in the executive branch as the Parish Administrator until January 1, 2016. As Parish Administrator, he served as Chief Executive Officer to the Parish President. Ms. Orgeron provided that during his public employment Mr. Chaisson answered directly to the Parish President and not the Lafourche Parish Council. The Lafourche Parish Coastal Zone Management Advisory Committee members are appointed by the Parish Council. The Lafourche Parish Coastal Parish Zone Management Advisory Committee was created by Parish ordinance. Mr. Chaisson would not receive any compensation as a member of the Lafourche Parish Coastal Zone Management Advisory Committee.
Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency, from assisting another person for compensation, in a transaction, or appearance in a connection with a transaction, involving that agency or rendering any service on a contractual basis to or for such agency.


Recommendations:
Adopt proposed advisory opinion.
