Request that the Board waive the $1,000 campaign finance late fees assessed Geraldine "Geri" Broussard Baloney, in her capacity as a candidate for Attorney General in the October 24, 2015 election, whose 2016 supplemental campaign finance disclosure report was filed 35 days late.
Facts:
Geri Broussard Baloney states that around January 13, 2017, the Louisiana Board of Ethics forwarded a letter to a P.O. Box that she no longer has. As a result, she received the correspondence late. Further, on September 1, 2016, she states her husband was diagnosed with stage 3 esophageal cancer. Since that time, she states that they have spent the latter part of 2016 and all of this year traveling to get treatment for him. She states that in April, 2016, her Treasurer, Katy Ohisson retired and if any notice was emailed to her, it was not received. It was her understanding that Mrs. Ohlsson zeroed out any outstanding balance and no further reporting was required. She stated that the only outstanding balance was the result of funds that she loaned to herself. She states that the loans were either paid or forgiven and the supplemented report now correctly shows a zero deficit.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee.
