Request for advisory opinion concerning post-employment restrictions relative to whether a person can own and operate a child care center licensed by the owner's previous employer, the Louisiana Department of Education.
Facts:
Kelly Enkey was employed for almost ten years by the Louisiana Department of Education. During her tenure with the Department of Education, Enkey worked as a teacher for eight years and as a Licensing Specialist for sixteen months prior to her leaving the Department of Education in May of 2017. Enkey's duties as a Licensing Specialist involved inspecting Daycare and Headstart facilities for compliance. Enkey intends to open and operate a daycare center called Honor Roll Pre-school.
Law:
La. R.S. 42:1121B prohibits a former public employee, for a period of two years following the termination of his employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt proposed advisory opinion.
