RE:
Request that the Board waive the $2000 campaign finance late fee assessed against Timothy "Tim" Larkin, in his capacity as a candidate for Councilmen at Large, City of Bossier City, Bossier Parish, in the March 25, 2017 election, whose 30-P campaign finance disclosure report was filed 91 days late.
Facts:
Timothy Larkin states he faxed the 30-P report to the Ethics Board after failed attempts to file the report using the LEADERS software. He states that his computer system runs on MAC OS 10.12.4 operating software. He states he has used it for the past 16 years filing reports with the Ethics Board without a problem. He states that all of his past reports, templates and information for filing are in the program application file on his computer and to this day remain inaccessible. After he received a notice of delinquency, he states he spoke with the IT department trying to resolve the issue, but the issue was not resolved so he faxed the report instead. He respectfully requests that the Ethics Board recognize that he did file his report and that the report clearly states that he did not form a campaign, did not accept any contributions, and did not expend any funds in connection with his uncontested candidacy for office. He provided information that he was given a packet for an "any other" candidate from the Clerk when he qualified, which says he is allowed to fax file his reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes immediately due and owing.
