Request that the Board waive the $1,380 campaign finance late fee assessed against John A. Brown, Sr., in his capacity as a candidate for Member of School Board, District 1, Orleans Parish in the October 24, 2015 election, whose 2016 supplemental campaign finance disclosure report was filed 23 days late.
Facts:
John A. Brown, Sr. states that after the 2015 election, his campaign had $15,000 in outstanding personal loans. He states he was unaware that he had to apply any contributions toward the retirement of the 2015 election debt in a supplemental report. He states that there were no other contributions or income reported on the 2016 filing. He states he reported all contributions received, but unfortunately reported those contributions on the wrong form. He states that once he was able to speak to someone from the Board of Ethics that was able to assist him in identifying where he made the error, he immediately filed the correct report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Waive the late fee.
