Advisory opinion request from Gregory Reggie regarding whether R.S. 42:1113A would prohibit his wife's company, Platinum Realty, from serving as the broker on a real estate transaction for the Louisiana Motor Vehicle Commission (LMVC) while he has a contract to supply legal services to the LMVC.
Facts:
Mr. Reggie stated that he is an attorney in private practice and that he has a contract to supply legal services on an as needed basis to the LMVC. He is not an employee of the LMVC. Mr. Reggie stated that under the terms of his contract, he has not and will not supply any legal services to LMVC regarding the purchase of the new building. He added that LMVC would not be required to provide any legal services toward the purchase of the building. Any legal services required would be provided through the Division of Administration.
Mr. Reggie stated that his wife owns Platinum Realty, a Louisiana licensed real estate agency, that employs several real estate agents, including himself. It is his understanding that LMVC is considering the purchase of a new building to house the agency. Mr. Reggie added that neither he nor his wife would act as the real estate agent on the sale of the property nor receive a commission related to the sale of the property. However, he did disclose that the company, Platinum Realty, would like to retain the brokers portion of the commission earned on the transaction with LMVC.
Law:
La. R.S. 42:1113A prohibits a public servant, a member of his immediate family or a legal entity in which either owns a controlling interest, from bidding on or entering into a contract, subcontract or transaction that is under the supervision or jurisdiction of the public servant's agency.
Recommendations:
Adopt draft advisory opinion.
