Request that the Board waive the $600 campaign finance late fee assessed against Scott Sartin, a candidate for City Judge, City Court, City of Winnsboro, Franklin Parish, in the October 24, 2015 election, whose 2016 supplemental campaign finance disclosure report was filed 19 days late.
Facts:
Scott Sartin states he maintained $343.49 in his account after the 2015 election, which he reported on the Supplemental report filed after that election in February 2016. He states that most of the money in this campaign fund account is his personal funds. He states he ran unopposed for re-election in 2016. He states he contacted the Board of Ethics to confirm what reports needed to filed with the understanding that he only had to file an affidavit saying that he was running unopposed and no money in his campaign account was spent. Since he had not touched this money, he stated he filed the affidavit and mistakenly believed that it was not necessary to file a supplemental report since his affidavit was a clear indication that none of the money in his campaign account was used. He states he received a late notice from the Ethics Board instructing him to file the supplemental report. He asks that the Board consider waiving the late fee assessment due to the fact that he didn't used any of the money in this account and the late fee assessed is almost double the balance being maintained in the account.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
