Charles E. Toney, Jr. states that he never campaigned for this seat and his intention was to withdraw from the race. He states that he attempted in person to withdraw from the race on January 23, 2017, because of the need to care for his newborn son. However, he stated that he was not allowed to withdraw because he did not attempt to withdraw before the seventh day after qualifying as the statute requires. He states that on January 25, 2017, shortly after the filing period closed, his newborn son was rushed to the emergency room as a result of a choking incident. He states he subsequently did timely file one campaign finance report, but did not realize he was required to file an additional report until the time frame had already lapsed. Upon realizing this error, he stated that he immediately filed the necessary reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
