Advisory Opinion request of Jeff Diez, on behalf of the Ascension Parish School Board, regarding nepotism prohibitions involving the immediate family members of head coaches.
Facts:
Annette Lowery is employed by Ascension Parish School Board as the head coach of the girls basketball team at Dutchtown High School. She is interested in hiring her daughter, Ashley Gudino, as an assistant coach on the girls basketball team. Ms. Lowery is not the athletic director for Dutchtown High School.
Comments:
AO 2014-1428: The Board applied the exception of 1119E to allow the employment of the immediate family members of the school's athletic director, who also happened to be the head boys basketball coach.
Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1119E provides that 1119 shall not prohibit the employment by a school board of an immediate family member of an athletic director of a school as a coach at such school.

La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

Recommendations:
Adopt the proposed advisory opinion.
