Consideration of a disqualification plan concerning the participation of Jimmy Densmore and Joey Densmore (brothers) who are employed in the Louisiana Department of Transportation & Development, Monroe District.
Facts:
Jimmy Densmore, DOTD District 05 Area Engineer, Area C, is the brother of Joey Densmore, Mobile Equipment Operator 2, Maintenance Gang 580. Both Jimmy and Joey are employed in the DOTD Monroe District. Joey Densmore was hired on May 12, 2015. Jimmy Densmore was hired on March 14, 2005 and promoted to Area Engineer in Area C on October 24, 2016. As a result of the promotion, Jimmy Densmore is now considered an immediate supervisor to Joey Densmore, however there are three (3) levels of supervision between them. Jimmy Densmore's promotion occurred more than one (1) year after Joey Densmore was hired.

A Disqualification Plan has been submitted whereby Jimmy Densmore is disqualified from any and all appointing authority duties regarding the employment of Joey Densmore. Any and all duties, decisions and/or approvals required by the Area Engineer that affect the employment of Joey Densmore are the responsibility of Marshall Hill, District 05 District Engineer Administrator, DOTD. Further, Jimmy Densmore has and will continue to recuse himself from any decision involving Joey Densmore's pay, performance evaluation, promotion, or any decision which involves a potential substantial economic interest for Joey Densmore.


Law:
La. R.S. 42:1112A prohibits a public servant from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.

La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C mandates that every public employee, excluding an appointed member of any board or commission, disqualify himself from participating in a transaction involving the governmental entity when a violation of Section 1112 would result.


Recommendations:
Approve the Disqualification Plan.
