Request for an advisory opinion as to whether a former Orleans Parish School Board employee who resigned to accept a job with the ExCEED Charter Management Organization can return to work for the Orleans Parish School Board.
Facts:
Nicolette London was employed in various capacities with the Orleans Parish School Board (OPSB) between 1992 and 2016. In 2016, Ms. London left her employment with OPSB to work for ExCEED Charter Management Organization (ExCEED). ExCEED considered but did not apply to OPSB for a charter to run schools currently run by the OPSB. ExCEED decided not to apply and never entered into a contractual relationship with the OPSB. Ms. London left her position with ExCEED on April 19, 2017 and desires to return to work with the OPSB.
Law:
La. R.S. 42:1121B(1) prohibits public employees from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed for a period of two years, or render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed, for two years.
Recommendations:
Adopt proposed advisory opinion.
