RE:
Request that the Board waive the $400 campaign finance late fee assessed against Greater Baton Rouge HBA Build PAC, and its committee's chairperson, Billy Ward, in the November 8, 2016 election, whose 40-G campaign finance disclosure report was filed 57 days late.
Facts:
Krystalin Schexnayder, with Capital Region Builders Association, states that the Executive Officer, Lynda Evans, who was handling the filing of the campaign finance reports, had been ill during the time the 40-G report was due. As a result, she states there were many things that did not get accomplished including the filing of the 40- G report. She stated that Ms. Evans has been diagnosed with a terminal brain tumor and is no longer with CRBA.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee pursuant to Rule 1205B.
