RE:
Request that the Board waive the $400 and $40 campaign finance late fees assessed against John I."Johnny" Shaddinger, Jr., a candidate for Mayor, City of Westwego, Jefferson Parish, in the April 6, 2013 election and the March 25, 2017 election, whose 2016 supplemental and 10-G campaign finance disclosure reports were filed 51 days and 1 day late, respectively.
Facts:
John I. Shaddinger states that the 10-G report was due by April 19, 2017. He states he completed the report and proceeded to fax it to the Board of Ethics that evening, but he was unable to get the report to immediately go through. Due to the length of the report, which was 17 pages, he states the fax was still in the process of going through at midnight. He states that the Board received the first pages by the deadline, but did not receive the last pages until after midnight. Based on this and that he has a history of timely filing and compliance, he respectfully requests that the late fee be waived.

Mr. Shaddinger stated that he did not understand that he was required to file a supplemental or annual report for both the April 6, 2013 and the March 25, 2017 elections in February. He states he timely filed the annual report for the March 25, 2017 election and later filed the 2016 supplemental report for the April 6, 2013 election when he was notified by the Board that he was required to file it.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee for the 10-G report.

Suspend all but $100 for the 2016 supplemental report based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
