RE:
Request for Advisory Opinion concerning whether the Caddo Council on Aging may contract with Always Best Care Senior Services - Shreveport, which employs a member of the Shreveport City Council.
Facts:
Michael D. Corbin is a Shreveport City Council member currently serving his second term which expires in 2018. Mr. Corbin is also employed by Always Best Care Senior Services - Shreveport in an administrative and sales capacity.

The Caddo Council on Aging is periodically awarded funds from the Shreveport City Council as a Civic Appropriation.

The Caddo Council on Aging is not an agency or department within the City of Shreveport, but is regulated by the Governor's Office of Elderly Affairs for the State of Louisiana.

Michael Corbin has no ownership in Always Best Care Senior Services - Shreveport. Further, Corbin would not receive any bonus or commission were the Caddo Council on Aging to contract with his employer.


Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant or legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or (B) from receiving a gift.
Recommendations:
Render an advisory opinion indicating that there would be no violation of the Ethics Code if the Caddo Council on Aging were to contract with Always Best Care Senior Services - Shreveport, employer of a Shreveport City Councilman.
