Advisory opinion request by Janna Maggio regarding whether she would be prohibited from continuing her employment as an adjunct professor at Northwestern State University (NSU) while her husband's brother, Dr. Chris Maggio, serves as the President of NSU.
Facts:
Dr. Maggio was appointed interim President of NSU, with his term commencing on January 1, 2017. He was appointed as the permanent President on May 4, 2017.
Janna Maggio was a pre-kindergarten teacher at NSU's Marie Shaw Dunn Child Development Center from August 1997 until August 2007. She served as teacher/instructor and Director of the Child Development Center at NSU from August 2007 until July 2014. However, she has served as an adjunct instructor at NSU since January 1993 until the present time and receives a W-2. Her employment in the capacity of adjunct instructor is dependent on the needs of the department, which is supervised by the Teaching and Learning College Department Head and Dean of the College of Education and Human Development.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1119C(2) provides that the provisions of this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of the public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, his immediate family member has a substantial economic interest.

Recommendations:
Adopt proposed advisory opinion.
