Advisory opinion request by Derek Boese regarding whether he may serve as an adjunct instructor at Tulane University while serving as the Chief Administrative Office (CAO) of the Southeast Louisiana Flood Protection Authority- East (SLFPAE).
Facts:
Derek Boese would be teaching a course in Critical Infrastructure and creating and teaching a course focused on Planning and Operations Management utilizing military principles in person and online. These courses would be taught after 6 p.m., which takes place after his 8 a.m.- 5 p.m. work hours for SLFPAE.
In his position as CAO of SLFPAE, he is responsible for protection against hurricane and river flooding in a specific area, and oversight over the administrative functions of Human Resources, Finance, Information Technology, Police and Administration for the agency. SLFPAE is not required to perform any education services to the public and he does not direct any business from SLFPAE to Tulane University. There is data that he could use from his tenure with SLFPAE, but it is publicly available information and is the same information he could use from his tenure with the U.S. Army Corps of Engineers.
Law:
La. R.S. 42:1111A provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115A(1) or (B) from receiving a gift.

Recommendations:
Adopt proposed advisory opinion.
