Advisory opinion request by Gary Evans, District Attorney 42nd J.D.C., regarding whether the brother of a DeSoto Parish Police Juror may bid on and buy adjudicated property, through Civic Source.
Facts:
Civic Source handles the sale of property adjudicated to the DeSoto Parish Police Jury as a result of failure to pay property taxes. The sales are by public bid and the property is sold by the Police Jury to the highest bidder. The brother of a currently serving Police Juror would like to bid on and buy adjudicated property being listed for public bid.

Staff requested additional information on May 23, 2017, June 2, 2017, and June 30, 2017. No responses were received from these requests.


Law:
La. R.S. 42:1113A provides that no public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Decline to render an opinion.
