Waiver request submitted by Stefan Marks, New Orleans Regional Planning Commission, regarding a $1500 late fee assessed for filing his amended 2014 Tier 2.1 annual pfd 277 days late.
Facts:
Mr. Marks stated that he did not receive the notice of delinquency asking for an amendment to his disclosure statement. He states that proof of signature is the only method to ensure the item is delivered to the proper person. Mr. Marks also points out that the street address on file with this agency list "Pendon" whereas the correct street name is "Rendon". Note: A review of the green card shows a signature that is similar to the signature on the PFD filed by Mr. Marks. However, the signature on the green card associated with the acceptance of the Late Fee Order is different from the signatures on the PFD and green card associated with the NOD. The signature on the green card for the Late Fee Order reads "Stephen Marks" and it was sent to "Pendon." The database record has been corrected to show the correct spelling of the street name.

Mr. Marks request that he be allowed to make an appearance before the Board when his matter is scheduled for consideration.

A copy of the both green cards and the PFD has been transmitted to Mr. Marks for his review.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
