RE:
Request for Advisory Opinion clarifying whether Calcasieu Parish Police Jurors, during the two (2) year period after leaving public office, are prohibited from engaging in transactions with special service districts created by Calcasieu Parish.
Facts:
Calcasieu Parish operates under the unit system of government and is governed by a fifteen (15) member Police Jury that is vested with policy making and legislative authority. A few Police Jurors will be leaving office in the near future and own businesses in Calcasieu Parish. The Police Jurors leaving office would like to know if they can contract or do business with the special service districts created by the Police Jury or whether the prohibitions contained in La. R.S. 42:1121 would apply.
Law:
La. R.S. 42:1121A prohibits a former agency head or elected official, for a period of two years following the termination of his public service, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt proposed advisory opinion.
