RE:
Advisory opinion regarding a former Department of Transportation and Development employee as to whether he can work part time for a company involving various road projects throughout the state.
Facts:
Ronnie Robinson retired from the Louisiana Department of Transportation and Development (DOTD) in February 2016 as an Assistant District Administrator, Engineering for District 61. District 61 is comprised of the following parishes: East Baton Rouge, West Baton Rouge, Ascension, Assumption, Iberville, Pointe Coupee, East Feliciana and West Feliciana. The scope of Robinson's work consisted of projects involving overlays, adding turn lanes, patching roadways, and striping.

In July 2017, Robinson began part-time employment with Gresham, Smith & Partners. Relative to his employment with Gresham, Smith & Partners, Robinson has worked on projects in Ouachita Parish and Concordia Parish involving "Local Roads Safety Program" and "Safe Routes to School Program."

During Robinson's tenure with DOTD, he did not work on projects involving Local Roads Safety Program" or "Safe Routes to School Program." Gresham, Smith & Partners anticipates receiving assignments for the above named programs in other areas of Louisiana, including the parishes located in District 61.


Law:
La. R.S. 42:1121 provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
