Request that the Board waive the $2,400 campaign finance late fee assessed against the LA Engineers Political Education Committee, a political action committee, its committee's chairperson, James T. Callahan, and treasurer, Brian E. Hickey, whose 2016 Annual report was filed 12 days late.
Facts:
Brian Hickey, Treasurer for LA Engineers Political Education Committee, states he has filed required reports with the Board, including the late annual report on February 27, 2017, 12 days late. The Board assessed a $2,400 late fee in its letter dated March 30, 2017. He respectfully requests that the Board reduce the $2,400 late fee assessed to the Louisiana Engineers Political Education Committee to $2,000. State law provides that if a report is filed more than 10 days late and the amount of activity on the report (here, $2,000) is less than the amount of the late fee to be assessed (here, $2,400), then the Board's staff may reduce the late fee to the amount of late- reported activity (here, $2.000) or 10 times the per -day penalty (here, $2,000), whichever is greater. See Board of Ethics Rules 1205(C). The late filing was entirely inadvertent, and, because the PAC's only 2016 activity was the $2,000 contribution made in April and reported in May, the late filing did not cause there to be any late disclosure to the Board or the public of any actual activity by the PAC.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
