Advisory Opinion request regarding the West Baton Rouge Museum nepotism policy.
Facts:
The West Baton Rouge Museum's (Museum) Personnel Policy provides that two members of an immediate family shall not be employed at the Museum at the same time.





Elizabeth Brantley was hired by the Museum as the Curator of Collections on July 7, 2017. Ms. Brantley's immediate supervisor is the Museum Director, Angelique Bergeron. Prior to Elizabeth Brantley's hiring, her mother, Toni Brantley, had been employed by the Museum since October of 2010 as a part-time Public Relations Officer. Based on the Museum's Personnel Policy, Toni Brantley resigned her employment with the Museum prior to the hiring of her daughter.

Toni Brantley has requested an exception to the Museum's Personnel Policy to allow her to return to her part-time position.

Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed advisory opinion.
