Advisory Opinion Request as to whether the appointment of J. Ruth Kennedy to the Board of Directors of Louisiana Health Care Quality Forum would violate La. R.S. 42:1121 as a result of her recent retirement from the Louisiana Department of Health and Hospitals.
J. Ruth Kennedy served as the State of Louisiana Medicaid Director from July 2012, to February 2016 and as Medicaid Expansion Project Director from February 2016 until her retirement in April 2017. As Medicaid Director, Ms. Kennedy directed planning and implementation of transformational reforms to the Louisiana medicaid delivery system, including payment reform and improvements in quality, disease management through Medicaid managed care and integration of behavioral health. As Medicaid Expansion Project Director, Ms. Kennedy was responsible for implementing the expanded Medicaid eligibility implemented by Governor John Bel Edwards.

Louisiana Health Care Quality Forum (LHCQF) is a non-profit organization which serves as the only neutral convener of stakeholders in the State of Louisiana by collaborating with providers, payers, purchasers and consumers of health care in Louisiana. In pursuit of that mission, LHCQF often works with the Medicaid arm of the Louisiana Department of Health and Hospitals.

LHCQF would like to appoint J. Ruth Kennedy to serve as an uncompensated member of the LHCQF Board of Directors.

La. R.S. 42:1121A(1)) provides that no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
