Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Phyllis Robinson from continuing to work in the Town of Lake Arthur since her brother, Auldon Robinson, was elected to the Town Council. The Town of Lake Arthur has a population of 2,738.
Facts:
Mayor Crochet provided that Phyllis Robinson has been employed with the Town to work in the town parks continually from the summer of 2012 to present. Ms. Robinson works from May to Labor Day and has been doing so each summer since 2012. She remains employed all year long even though she only receives a pay check and provides services from May until Labor Day. She does not have to apply annually. Each year she is simply contacted and told when and where to report to work in May.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1119C(2) provides a limited exception to the general nepotism prohibition and allows the continued employment and normal promotional advancement of a public employee when a member of the public employee's immediate family becomes the agency head of the public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.
Recommendations:
Adopt draft advisory opinion.
