Advisory Opinion Request regarding whether a school board member's daughter could be employed as a bus driver for the Livingston Parish School Board
Facts:
General counsel for the Livingston Parish School Board requested an advisory opinion as to whether a school board member's daughter could be employed as a bus driver for the Livingston Parish School Board. Counsel for the school board pointed out that 2012 legislative changes (Act One) gave sole authority to superintendents for personnel matters including the hiring, firing and promotion of employees.
Comments:
General counsel has failed to provide requested information as to the identity of the immediate family member of the school board member.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
Recommendations:
Decline to render.
