Advisory opinion request from the Executive Director of the Office of Community Development (OCD).
Facts:
Mr. Forbes requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit his daughter, Caroline Forbes, from accepting a position with SBP, a private non-profit that helps repair homes after a disaster. SBP has received loans and grants from OCD in the past. At least one loan is outstanding. Mr. Forbes stated that Caroline Forbes would not be an officer or Director of SBP and would not sign any grant proposals or loan documents that would be submitted to OCD.


Law:
La. R.S. 42:1113A prohibits a public servant or a member of such public servant's immediate family or a legal entity in which he has controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency.

La. R.S. 42:1114 requires the immediate family member of a public servant, who derives a thing of economic value, directly, through any transaction, involving the agency of such public servant or who derives a thing of economic value through a person which has bid on or entered into or is in any way financially interested in any contract, subcontract, or any other transaction under the supervision or jurisdiction of the agency of such public shall file a disclosure statement annually with the Board of Ethics stating: 1) the amount of income derived, 2) the nature of the business activity, 3) name and address, and relationship to the public servant, and 4) the name and business address of the legal entity.

Recommendations:
Adopt draft advisory opinion.
