Disqualification Plan request from LSU President, F. King Alexander, regarding Dr. Ghali Ghali, Chancellor of the LSU Health Sciences Center in Shreveport.
Facts:
Dr. Ghali Ghali serves as the Chancellor of the LSU Health Sciences Center - Shreveport ("LSUHSC-S"), the Dean of the LSUHSC-S School of Medicine, and the Chair of the Department of Oral and Maxillofacial Surgery ("OMS").

Under normal circumstances, Dr. Ghali, as Chancellor, would execute contracts between third parties and the Louisiana State University Board of Supervisors ("LSU Board") on behalf of, and relating to, the clinical services of LSUHSC-S, including the OMS Department. Additionally, the Chair of the OMS Department would normally inform the Chancellor as to whether the OMS Department is capable of, and intends to provide the services, that would be required pursuant to third party contract. Dr. Ghali has no interest nor receives any compensation from these third parties.


Due to the potential for conflicts, Dr. Ghali has asked that a disqualification plan be implemented to insulate him from any participation as Chancellor in decision-making concerning all contracts between third parties in which he has a substantial economic interest and the LSU Board that concern the OMS Department at LSUHSC-S.

The proposal provides that Dr. F. King Alexander, as President, or a representative from his office, shall be responsible for any decisions as to whether the LSU Board would give notice of non-renewal of existing contracts and/or would enter into any new contracts for the provision of services by the OMS Department. This disqualification plan will not have an impact on the efficient operation of the LSUHSC-S or the OMS Department.

Law:
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
Recommendations:
Approve the disqualification plan.
