RE:
Advisory Opinion request from Trinissa Reff, Youth Career Advisor Team Lead with the City of New Orleans, who seeks employment with a private organization that has been awarded a contract by the City of New Orleans to perform the services that Reff performed for the City.
Facts:
Trinissa Reff is employed by the City of New Orleans as a Youth Career Advisor Team Lead under the federally funded Workforce Innovation and Opportunity Act employment and training program. Effective October 1, 2017, the City of New Orleans will privatize the services provided under the Workforce Innovation and Opportunity Act, thereby terminating the position held by Trinissa Reff.

Reff desires to become employed by an organization which will be awarded a contract by the City of New Orleans to perform employment and training services once provided by Reff.

Reff was not involved in the procurement process to privatize the governmental services nor did he have any influence in the selection of the providers that were awarded contracts to provide services.

Comments:
The City of New Orleans decided to privatize the governmental services relative to the Workforce Innovation and Opportunity Act, leaving Rinissa Reff and other employees without employment.
Law:
La. R.S. 42:1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed Advisory Opinion.
