Advisory opinion request from Washington Parish Gas Utility District #2 (pop. 47,168) relative to a board member employed as a Regional Sales Coordinator for AFLAC insurance, which has contracted with employees of the Utility District.
Facts:
Joe Felder was appointed to the governing board of the Washington Parish Gas Utility District #2 on February 9, 2015. Felder holds the position of Regional Sales Coordinator for the Northshore Region for AFLAC Insurance, which provides various insurance products including, vision, dental, medical and disability coverage.

In March 2015, several employees of the Utility District purchased various policies of their choosing from AFLAC. The premiums are paid through payroll deduction, however the insurance was not sanctioned by the Utility District nor does the Utility District contribute to the payment of the premium.

Felder played no role in selling the insurance to the employees nor does he receive a commission that may be generated by the premiums paid.


Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns a interest from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person (1) has or is seeking to have a contractual, business or financial relationship with the public servant's agency; (2) conducts operations or activities that are regulated by the public employees' agency; or, (3) has a substantial economic interest which may be substantially affected by the performance or nonperformance of the public employee's official duty.
