Advisory opinion request regarding whether the Code of Governmental Ethics (Code) would prohibit David Jarrell from purchasing two pieces of property from St. Bernard Parish while he is employed as an Assistant District Attorney for the 34th JDC in the Civil Division.
Facts:
Mr. Jarrell provided that he is interested in purchasing two pieces of property from the St. Bernard Parish Government that are currently in the inventory of property acquired from the Louisiana Land Trust a/k/a The Road Home Program. He wishes to purchase the properties for personal use and would not develop the properties. For this reason, he would have to request that the St. Bernard Parish Council remove these properties from the "Buy and Build" program so that they can be returned to the general inventory of property. Mr. Jarrell added that he may have to submit a request that these properties be declared as surplus property.


Mr. Jarrell provided that any petition to purchase these properties from the "Buy and Build" program to return them to the general inventory of the former Louisiana Land Trust will not require any review or any input from, his agency, the Civil Division of the 34th JDC District Attorney's Office. Contract counsel has been hired by the Parish to provide services as closing attorneys for the completion of the sale of these properties. He added that the Civil Division has no input on which attorneys are hired to provide the closing services.

Law:
La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt draft advisory opinion.
