RE:
Advisory opinion request regarding whether the Code of Governmental Ethics (Code) would prohibit Jack "Bump" Scaggs, a member of the Bossier Parish Police Jury, from continuing to serve as the COO of the Coordinating and Development Corporation (CDC). Additionally, whether the Code would prohibit Mr. Scaggs from being promoted to CEO of the CDC if selected.
Facts:
Mr. Scaggs provided that the CDC was created as the Louisiana State Planning and Development District 7 pursuant to La. R.S. 33:140.61. The CDC is a registered as a 502(c)(4) non-profit Corporation. The purpose of the CDC is to facilitate intergovernmental cooperation and to insure the orderly and harmonious coordination of state, federal, and local comprehensive planning and development programs. As COO, Mr. Scaggs stated that he does not have general executive authority to act for the CDC; however, if promoted to CEO, he would. The CDC was created to serve the economic development and planning needs of ten Louisiana parishes.
Mr. Scaggs provided that the CDC does not have any contractual, business or financial relationships with Bossier Parish. Bossier Parish Police Jury is not a member of the CDC, nor does it appoint any members to the CDC. He added that Bossier Parish does not pay any dues or make any contributions to the CDC. Mr. Scaggs stated that the Bossier Parish Police Jury does not have any supervision or jurisdiction over the CDC.
Recommendations:
Adopt draft advisory opinion.
