David B. Ellis is an elected member of the Mandeville City Council and has been employed byArthur J. Gallagher & Company (Gallagher) for more than fourteen months as a salaried, non-commissioned insurance consultant. Mr. Ellis owns less than 1% of the shares of Gallagher stock. St. Tammany Fire Protection District #4 (District) issued a Request for Proposals for a group health insurance plan for which Gallagher would like to participate. The District was created by the St. Tammany Parish Council and is comprised of five Commissioners, two of which are required to be appointed by the Mandeville City Council.

La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1111C(2)(d) prohibits a public employee from receiving compensation for or in consideration of services rendered to or for any person who has or is seeking a business, contractual or financial relationship with his agency.
