RE:
Advisory opinion request of Alison Miller, Executive Director of the Vermilion Parish Tourist Commission, regarding the annual PFD filing requirement.
Facts:
The Vermilion Parish Tourist Commission was created by the Vermilion Parish Police Jury in 1992 pursuant to La. R.S. 33:4754. The Tourist Commission is a voluntary board where no member receives compensation. The board manages a yearly budget of less than $50,000. Members are appointed by the Vermilion Parish Police Jury. Vermilion Parish has a population of 57,999.
Comments:
AO 2017-2015 - Board found that the Vermilion Parish Library Board was not required to file PFD on basis that Board was created by Police Jury and population was less than 200K.
Law:
La. R.S. 42:1124.2.1A(1) provides that each member and any designee of a member of a board or commission that has the authority to expend, disburse, or invest ten thousand dollars or more of funds in a fiscal year.

La. R.S. 42:1124.2.1D(1)(b)(ii) provides that a "Board or commission" shall not mean any board or commission or like entity that governs a political subdivision created by a single parish governing authority of a parish with a population of two hundred thousand or less, or any subdistrict of such a political subdivision.

Recommendations:
Adopt the proposed advisory opinion.
