Disqualification plan regarding Lowell Duhon, Chief Administrative Officer of Lafayette City-Parish Consolidated Government, in transactions involving his son, Manny Duhon, or his son's employer, Grant Street Dance Hall.
Facts:
In his capacity as Chief Administrative Officer of Lafayette City-Parish Consolidated Government (LCG), Lowell Duhon or his designee is required by ordinance to be involved in the administration of Chapter 6 of the LCG Code of Ordinances, which regulates the sale of alcoholic beverages within the City of Lafayette. Specifically, Mr. Duhon or his designee is required to conduct an informal hearing with the alcoholic beverage license holder to determine whether the alcoholic beverage license should be suspended or revoked as a result of conduct of its employees. Lowell Duhon's son, Manny Duhon, is employed as a bartender at Grant Street Dance Hall, which has been cited for certain violations of Chapter 6 of the LCG Code of Ordinances, including one alleged violation involving Manny Duhon's conduct.

LCG and Lowell Duhon submitted a disqualification plan disqualifying Lowell Duhon from any responsibility regarding the investigation, informal hearing, or determination of a violation of Chapter 6 of the LCG Code of Ordinances alleged to have been committed by Manny Duhon or his employer, Grant Street Dance Hall. Under the proposed disqualification plan, any and all duties and authority as to the administration of Chapter 6 of the LCG Code of Ordinances related to matters affecting the alcoholic beverage license of Grant Street Dance Hall and its employee, Manny Duhon, will be handled by Sally Leger, the Director of Alcohol and Noise Control. In the event that Sally Leger requires guidance on any issues that arise during the investigation or hearing of any violations of Chapter 6 of the LCG Code of Ordinances involving Manny Duhon or his employer, Grant Street Dance Hall, she will report directly to Joel Robideaux, the Mayor-President of LCG.

Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
Recommendations:
Approve the disqualification plan.
