Reconsideration of the Board's denial of a waiver request submitted by Carrie Modica, a member of the St. Tammany Parish Recreation District #6, regarding a $1,500 late fee assessed for filing her 2015 Tier 2.1 annual PFD 42 days late.
Facts:
Ms. Modica states that a family member signed for the NOD on 11/18/16 while Ms. Modica was away on a family vacation. The vacation was from 11/17/2016 to 11/26/2016. Initially, it appeared that Ms. Modica received and signed for the mail prior to leaving on vacation. However, she has now submitted an affidavit from her sister who provides that she signed the green card. Her sister also states that she called Ms. Modica and read her the letter. Ms. Modica sent an email to staff on 11/18/16. Staff responded on 11/21/16 advising how to file online. Ms. Modica stated that she incorrectly assumed she could file it late.

When she returned home, Ms. Modica stated that she was admitted to the hospital for major surgery and was subsequently put on six weeks of bed rest. She discovered the NOD upon returning to work and filed the report that same day - January 12, 2017.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
