Advisory opinion request by Joel Davidson regarding whether he may serve as a member of the Holy Angels Board of Directors within two years of his termination from the Louisiana Department of Health (LDH).
Facts:
Joel Davidson served as a Program Manager for the Medicaid program section handling the rate setting for all nursing homes, transportation providers, and intermediate care facilities until June 4, 2017. He supervised three employees with input in the promotion or hiring of employees; however, the Section Chief had final approval over employee actions. In this position, he audited cost reports submitted by providers including reports submitted by Holy Angels. While employed by LDH, Holy Angels requested an informal hearing to appeal an audit finding that was reviewed by his staff. This request was eventually rescinded with no change by his agency. Mr. Davidson is currently employed as the Project Manager in the Finance Department of the Louisiana State University Health Sciences Center in Shreveport and has no affiliation with LDH.
Holy Angels is an intermediate care facility that has asked Mr. Davidson to join their Board of Directors. This position is a not compensated in any way. He stated that he would have no official job duties with Holy Angels and would not represent nor contact LDH on their behalf.
Law:
La. R.S. 42:1121B provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
