RE:
Advisory opinion request by Lindsey Hunter, Legal Counsel for the Louisiana Department of Agriculture and Forestry, regarding members of the Louisiana Beef Industry Council (LBIC) being able to make a motion or vote on a motion to approve funds or disbursements/reimbursements to organizations that appointed such members to the Council.
Facts:
The members of the LBIC are appointed by the following nonprofit organizations but are not employed in any capacity by: the Cattlemen's Association, Louisiana Farm Bureau Federation, Louisiana Livestock Auction Markets Association, and the Cattle Producers of Louisiana. LBIC members receive no salary from their respective appointing authorities or the LBIC for their service, but are reimbursed for travel and other expenses from the LBIC. The Council may expend funds to pay funds to other organizations for work or services performed which are consistent with the objectives of the Beef Promotion and Research Program. Appointing organizations are involved in the cattle industry and may perform services which would qualify for reimbursements.




Additionally, Council members may seek to present a project for funding/reimbursement to the Council for consideration on behalf of the organization which appointed him. Some of the members of the LBIC serve as vice president or other officer in their appointing organizations. Others serve as members of executive committees or members representing a specific district within the organization.

Law:
La. R.S. 42:1112B(3) provides that no public servant shall participate in a transaction involving his governmental entity in which any person of which he is an officer, director, trustee, partner, or employee.
Recommendations:
Adopt proposed advisory opinion.
