Mr. Darby stated that at the time he received the NOD he was "...in the midst of severe emotional trauma caused by personal family matters." Mr. Darby explained that he and his siblings provide extensive care for their elderly mother; and he is also responsible for the care of his eldest sister who is on disability. Mr. Darby further stated that beginning in January 2016 he and his wife began divorce proceedings which has caused him severe trauma to the point of losing work and consuming his day. Mr. Darby also stated that the imposition of a late fee would cause a severe financial hardship. Correspondence was sent to Mr. Darby requesting that he submit supporting documentation.
According to the supporting documentation, Mr. Darby's states that his mother began experiencing shortness of breath in September 2016 and medical tests showed multiple arterial blockages. The only medical documentation attached shows an appointment with a doctor in October 2017. Another document shows that his sister was treated for GERD on January 6, 2017. He also submitted his Petition for Divorce that he states was filed on June15, 2017.

La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4
of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
