Advisory opinion request as to whether Cynthia F. Cockerham may continue her part-time employment as Executive Director of the LaSalle Economic Development District after she retires from her position as a community development educator with the LSU AgCenter in West Carroll Parish.
Facts:
Cynthia Cockerham would like to continue her part-time employment as Executive Director of the LaSalle Economic Development District (LEDD) after she retires from her position as a community development educator with the LSU AgCenter in West Carroll Parish. In 2011, Ms. Cockerham accepted a job assignment, with the approval of the LSU AgCenter, as Executive Director of LEDD, a political subdivision of the State of Louisiana created pursuant to La. R.S. 33:130.201. An agreement was reached between the AgCenter and LEDD which provided that she work 80% of her time for LEDD and 20% of her time for the AgCenter. Through this agreement, LEDD reimburses the AgCenter for 80% of her time, benefits, travel and supplies as related to the educational programming.
Law:
La. R.S. 42:1121A(1) prohibits a former agency head or elected official, for a period of two years following the termination of his public service as the head of such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or from rendering any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
