Request that the Board waive the $3,000 campaign finance late fee assessed against the LA Republican Judiciary PAC, Inc., a political action committee, its committee's chairperson, Scott Wilfong, and treasurer, Jerry Arbour, whose 40-G report was filed 42 days late.
Facts:
Bryan G. Jeansonne, report preparer for LA Republican Judiciary PAC, Inc, states that he is responsible for filing the PAC's reports and the error was on his part. He states he mistakenly filed the incorrect initial report and then forgot to file the subsequent 40-G report. He states that the reports have been corrected and all required reports have been filed. If the board does not want to waive or suspend the late fee, then he asks that, in the alternative, the late fee be assessed against him since it was his error that resulted in the late filing.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $800 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
