Waiver request submitted by Christopher "Chris" Jowers, Constable, Ward 7 - Calcasieu Parish, regarding a$1400 late fee assessed for filing his 2016 Tier 2 annual pfd 14 days late.
Facts:
Mr. Jowers explained that he thought he had filed the PFD; however, he later learned that the form he filled out was the financial statement required by the Legislative Auditor. Mr. Jowers attempted to fax the PFD to our agency using the Nibblets Bluff Park fax machine; however, that office was packing and removing things from the office due to Hurricane Harvey. Mr. Jowers provides a statement from the Nibletts Bluff Park Office Manager wherein she states that Mr. Jowers made an attempt to fax information; however, the office was closed.

Mr. Jowers further stated that he is also a volunteer fire fighter and first responder. As such, he helped the community by rescuing people from their flooded homes, and also helped with cleaning out homes. Mr. Jowers also stated that his house was surrounded by water and he had to boat in and out.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
