RE:
Request for Advisory Opinion relative to tutoring students at Benjamin Franklin High School (New Orleans).
Facts:
David Ferris, Academic Assistant Principal at Benjamin Franklin High School in New Orleans, sought an interpretation of conflict of interest guidelines for public school teacher. Several teachers have questioned the school administration whether they would be allowed to tutor a student attending the school but not currently a student of that teacher.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving any thing of economic value for services rendered to or for any person from whom the public servant would be prohibited from accepting a gift under Section 1115B(2) of the Code.

Recommendations:
Adopt the proposed Advisory Opinion.
