RE:
Request that the Board waive the $2,500 campaign finance late fee assessed against Paulette R. Irons, a candidate for Mayor, City of New Orleans in the February 2, 2002 election, whose 2016 supplemental campaign finance disclosure report was filed 217 days late and a request that the Board waive the $2,500 campaign finance late fee assessed against Paulette R. Irons, a candidate for Judge, Civil District Court, Division M in the November 4, 2014 election, whose 2016 Supplemental campaign finance disclosure report was filed 216 days late.
Facts:
Paulette R. Irons states in February of 2016 she changed her report preparer who had been filing the reports due to the lack of attention to these filings and numerous fines. She states the current preparer had a notification that reports were to be filed for 2015. However, she states this was his first time filing these reports.
She states that due to her ignorance and his newness, an assumption was made that a notification would be sent for the 2016. She states they are now aware that a report is due EVERY February. She states that their system was inadequate and they have since made the necessary adjustments to insure promptness in filing. She states the reports were immediately prepared for BOTH Accounts and have been submitted. She states the account for Mayor February 2, 2002 has been totally exhausted and $2500.00 would be a hardship.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for both 2016 supplemental reports.
