Appearance in connection with a request that the Board waive the $2,500 campaign finance late fee assessed against Marlin N. Gusman, a candidate for Sheriff, Orleans Parish, in the October 14, 2017 election, whose 180-P campaign finance disclosure report was filed 102 days late.
Facts:
Alesia M. Ardoin, attorney for Marlin Gusman, states that report preparer was not aware that the Sheriff's election was scheduled for the fall and that the 180 -P report was due. It is requested that the late fee of $2,500 be reduced to $400 (the four day rate) because no notice of delinquency was sent. Once the campaign was notified that the report was delinquent, she states that the report was immediately filed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
