RE:
Advisory opinion request by Anthony Marshall regarding whether La. R.S. 42:1119 would prohibit Dr. Regina Enwefa or Dr. Stephen Enwefa serving as the Chairperson of the Department of Speech Language Pathology (Department) while the other remains employed by the Department.
Facts:
Dr. Regina Enwefa and Dr. Stephen Enwefa are married to each other. Dr. Regina Enwefa's initial date of employment by Southern University and A&M College as Faculty/Program Director of the Department of Special Education and Communication Disorders, now Department of Speech Language Pathology, was January 5, 2005. She remains serving in this capacity. Dr. Stephen Enwefa has been employed by the same Department as a faculty member since August 14, 2006. The Department Chairperson position has become available.

Comments:
Staff was unable to verify that Mr. Marshall represents Dr. Regina Enwefa or Dr. Stephen Enwefa after multiple attempts.
Law:
La. R.S. 42:1119 provides that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1119C(2) provides that the provisions of this Section shall not prohibit the continued employment of any public servant nor shall it be construed to hinder, alter, or in any way affect the normal promotional advancements for such public employee where a member of the public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
